Introduction

These Terms of Service ("Terms") govern your use of KissPixel's website and AI image generation services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

Use of Services

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, secure, or error-free. KissPixel reserves the right to modify, suspend, or discontinue any aspect of our services at any time without notice.

User Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for safeguarding your account and for all activities that occur under your account. You must be at least 18 years old or have the consent of a parent or guardian to use our services.

Credits System and Subscriptions

• Credits: Our services operate on a credit-based system. Credits are required to generate images using our AI tools.
• Free Credits: New users receive complimentary credits upon registration to start exploring our services.
• Subscription Credits: Users with monthly or annual subscription plans receive an allocation of credits monthly from their subscription start date.
• Credit Allocation: The number of credits allocated depends on your subscription tier.
• Credit Expiration: Credits from subscriptions have a validity period of one month from the date they are issued and do not roll over to the next period.
• Payment Processing: All subscription payments are processed securely through our payment processors. By subscribing, you agree to provide accurate billing information.
• Plan Changes: If you switch to a new subscription plan, we will not provide refunds for months where credits have already been issued.
• Upgrade Policy: In the Stripe Customer Portal, you can upgrade from a monthly plan to an annual plan. Once you upgrade to an annual plan, you cannot downgrade back to a monthly plan.
• Refunds: Refund requests are evaluated on a case-by-case basis. To request a refund, please contact support@kisspixel.ai.
• Cancellations: You may cancel your subscription at any time. Upon cancellation, you will retain access to your subscription benefits until the end of your current billing period.

Usage Limitations

• Fair Use: We reserve the right to limit excessive usage that may impact service performance for other users.
• Usage Monitoring: We monitor platform usage patterns to maintain system stability and prevent abuse.
• Content Restrictions: Our AI systems include content filters to prevent the generation of harmful, illegal, or explicit content. Attempting to circumvent these filters is prohibited. If our system detects deliberate attempts to generate illegal content, the credits consumed for such attempts may not be refunded.

Intellectual Property

Our website and its original content, features, and functionality are owned by KissPixel and are protected by international copyright, trademark, and other intellectual property laws.

User Content and Generated Images

• User Uploads: You retain all rights to the images you upload to our services.
• AI-Generated Images: You receive ownership rights to the images generated through our AI services, subject to the following conditions:
  • You have paid for or legitimately obtained the credits used to generate the images.
  • The images do not infringe on third-party rights or violate our content policies.
• Commercial License: Images generated using our services come with a commercial license, allowing you to use them for both personal and commercial purposes.
• License Limitations: You may not:
  • Claim that AI-generated images were created entirely by humans.
  • Resell or redistribute the raw AI-generated images as stock photos or AI training data.
  • Use generated images for illegal, harmful, or fraudulent purposes.
• Data Retention: Uploaded and generated images are retained on our servers for different periods based on your account type:
  • Free users: Images are retained for 7 days
  • Pro users: Images are retained for 30 days
• Content License: By uploading content to our services, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing and improving our services.

Prohibited Activities

You agree not to:

• Use our services in any way that violates any applicable law or regulation
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of our services
• Attempt to gain unauthorized access to our servers or networks
• Use our services to distribute malware or other harmful code
• Generate or attempt to generate content that is illegal, harmful, discriminatory, or explicit
• Scrape, data-mine, or extract data from our services using automated methods
• Reverse engineer or attempt to extract the source code of our software
• Use our services to infringe on intellectual property rights
• Share your account credentials with others or allow multiple users to access a single account

Content Moderation

• We employ automated systems to review both text prompts and generated images.
• Content that violates our policies may be blocked from generation.
• Repeated violations may result in account suspension or termination.
• We reserve the right to review user content when necessary to ensure compliance with our policies.

Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Engaging in prohibited activities
• Non-payment of fees
• Extended periods of inactivity
• Upon request by law enforcement or regulatory authorities
• Detection of fraudulent, illegal, or suspicious payment methods

If we detect that you may be using fraudulent, illegal, or suspicious payment methods to purchase subscription plans, we may proactively issue a refund and cancel your subscription without prior notice.

Upon termination, your right to use the services will cease immediately. To request account deletion, please contact support@kisspixel.ai.

Limitation of Liability

In no event shall KissPixel be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services. Our total liability for all claims related to our services shall not exceed the amount you paid to us for the services in the preceding three months.

Indemnification

You agree to indemnify and hold KissPixel harmless from any claims, damages, liabilities, costs, or expenses (including attorney fees) arising from your use of our services or violation of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by posting the updated Terms on this page and sending an email notification to users where appropriate. Your continued use of our services after such modifications constitutes your acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
